1. Privacidad

2. Definitions and Scope

“Personal data” means information that identifies, relates to, or can reasonably be linked to a person, such as name, email address, account ID, device identifier, IP address, payment record, support request, workspace record, or personal information included in tool inputs.

This Policy applies when NiuTools acts as a data user under the Hong Kong PDPO, including when we provide the website, accounts, workspace, Chinese learning tools, AI-assisted features, subscriptions, and support services to individual users. If we process data on behalf of an enterprise customer, that processing is governed by the applicable business agreement or data processing agreement.

3. Personal Data We Collect

Data you provide includes account and contact details, such as name, email, password hash, language preferences, workspace content, history, favorites, settings, tool inputs and outputs, local Ask conversations, feedback, support communications, subscription choices, AI credit adjustment or compensation records, password reset requests, and other information you choose to provide.

Data generated when you use the Services includes IP address, device type, browser, operating system, page visits, clicks, feature usage, AI credit usage, error logs, request times, session information, and identifiers collected through cookies, local storage, or similar technologies.

Payment-related data is handled by Stripe, PayPal, or another payment provider enabled at checkout, such as billing name, email, billing address, payment method, transaction status, subscription status, invoice records, customer IDs, and subscription IDs. NiuTools does not directly store full payment card numbers.

We may receive limited information from third parties, such as payment and subscription status from Stripe or PayPal, email delivery status from Resend, product analytics from PostHog, and operational information from error monitoring recipients or security providers.

4. How We Use Personal Data

We use personal data to provide and maintain the Services, including account creation, authentication, workspace history and favorite syncing, user settings, tool requests, AI output generation, usage display, subscription management, AI credit adjustments or compensation, password reset emails, and customer support.

We use personal data for security and compliance, including preventing abuse, detecting abnormal requests, enforcing rate limits, investigating Terms violations, protecting users and the platform, handling refunds, tax, accounting, and legal requests.

We use personal data to improve product experience, including understanding feature usage, debugging, improving Chinese learning tools, optimizing interface design, evaluating AI feature quality, creating anonymous or aggregate statistics, and developing new learning and writing features.

We may send service communications, such as account security, subscription status, usage, policy updates, or support responses. If we send marketing communications, we will obtain consent where required and provide an unsubscribe method.

5. AI Inputs, Outputs, and Model Services

When you use Ask, grammar checking, email rewriting, or other AI features, we process submitted text, tool context, settings, generated results, usage records, and technical logs to complete requests, enforce usage limits, troubleshoot issues, and maintain safety.

Current AI requests are sent to DeepSeek or an equivalent model provider configured by us. We aim to send only the data needed to complete the request and use server-side authentication, quota checks, input length limits, rate limits, and logging controls to reduce unnecessary exposure.

The current product does not provide a user-facing model training toggle. Unless we give separate notice and obtain applicable consent, or you have a separate written agreement with us, we do not sell your private workspace content to third parties and do not provide saved workspace history to third parties as a public training dataset. We may use anonymized, aggregated, or appropriately protected data to evaluate, debug, and improve NiuTools.

6. Purposes and Legal Bases

We collect and use personal data to provide accounts and workspace services, process AI requests, save history and favorites you choose to save, manage AI credits, process payments and subscriptions, send password reset emails, provide support, maintain security, prevent abuse, analyze and improve the product, and meet legal and accounting obligations.

Under Hong Kong PDPO principles, we collect personal data by lawful and fair means, collect no more than is necessary for the relevant purpose, and use it only for the purposes described in this Policy or purposes directly related to your use of the Services. If we want to use personal data for a new purpose, or for direct marketing that requires consent, we will obtain consent as required by law.

7. How We Share Personal Data

We may share personal data with service providers that support hosting, databases, AI models, email, payments, analytics, error monitoring, security, support, content moderation, subscription management, and operations. Current provider categories include DeepSeek for AI models, Stripe and PayPal for payments and subscriptions, Resend for email, PostHog for product analytics, Postgres database/hosting providers, error monitoring webhook recipients, and necessary infrastructure providers.

We may share data where needed for legal, compliance, safety, or rights-protection reasons, such as responding to lawful requests from courts, regulators, law enforcement, tax authorities, or payment networks, enforcing our Terms, or protecting NiuTools, users, and the public.

If NiuTools is involved in a merger, financing, acquisition, reorganization, asset sale, or similar corporate transaction, personal data may be disclosed or transferred as part of evaluating or completing that transaction. We may also share information when you consent or direct us to do so.

8. International Data Transfers

NiuTools operates through a Hong Kong company, but our service providers may process, store, or access personal data outside Hong Kong or your country or region. For example, AI, payment, email, analytics, database, hosting, and error monitoring providers may be located in the United States, Singapore, the European Union, or other regions.

Data protection laws may differ across regions. We take reasonable steps under PDPO data protection principles and applicable law, including vendor review, data processing terms, access controls, encrypted transmission, transfer minimization, and other technical and organizational measures.

9. Data Retention

We keep personal data only as long as needed for the purposes described in this Policy, unless a longer period is required or permitted for legal, accounting, tax, safety, dispute, backup, or compliance reasons.

Account data, workspace history, favorites, settings, and subscription records are generally retained while your account is active. You may delete individual saved history records or clear saved history. Account deletion requests are currently recorded in user settings and processed by administrators. After processing, related account and workspace data will be deleted or anonymized from active systems within a reasonable period. Backups, logs, payment, accounting, security, dispute, or anti-abuse records may remain for applicable retention periods.

The system automatically cleans up expired sessions, expired password reset tokens, and expired rate limit buckets. We do not keep personal data longer than necessary for the relevant purpose unless a longer period is required or permitted for legal, accounting, safety, dispute, backup, or compliance reasons.

10. Cookies and Similar Technologies

We and third-party providers may use cookies, pixels, SDKs, local storage, or similar technologies to keep you signed in, remember preferences, store local drafts, Ask conversations and history cache, maintain security, analyze visits, understand feature usage, and improve the Services.

Cookies and local storage may include necessary authentication and security data, functional preferences, workspace local cache, and product analytics collected through PostHog. PostHog is currently configured for autocapture, pageview, pageleave, and localStorage+cookie persistence.

You can block or delete cookies and local storage through your browser settings, but login, workspace preferences, local history cache, local Ask conversations, or analytics opt-out state may not work properly.

11. Your Privacy Rights and Choices

Under the Hong Kong PDPO, you have the right to request access to personal data we hold about you and to request correction of inaccurate personal data. Depending on where you live, you may also have rights to request deletion, portability, restriction, objection, withdrawal of consent, account closure, marketing unsubscribe, or information about how we share your personal data.

You can manage some profile details, history, preferences, and notifications in account settings. You may also submit access, correction, deletion, or other privacy requests by emailing privacy@niutools.com. To protect your account, we may need to verify your identity or location before fulfilling a request, and may charge a reasonable fee or refuse requests that are manifestly unfounded, repetitive, or beyond what applicable law requires.

Some rights may be limited by legal exceptions, such as when we need to retain data to complete transactions, maintain security, prevent fraud, comply with legal obligations, resolve disputes, or protect legal rights. You may also have the right to lodge a complaint with the Office of the Privacy Commissioner for Personal Data in Hong Kong or your local data protection authority.

12. Direct Marketing and Analytics Choices

We currently focus on service communications, such as account, security, password reset, subscription, usage, policy update, and support messages. If we later use your personal data for direct marketing, we will provide the required notice of marketing purpose, data classes, and opt-out method under Hong Kong PDPO, and obtain consent where required.

You may opt out of marketing communications through an unsubscribe link or by emailing privacy@niutools.com. For PostHog or other analytics tools, you may limit cookies/local storage in your browser, or adjust analytics choices if we provide a preference center.

13. Third-Party Links and Services

Our Services may link to third-party websites, products, or services and may rely on third-party login, payment, AI, analytics, support, hosting, or email services. Third-party privacy practices are governed by their own policies.

Please review third-party privacy policies before providing information to them. NiuTools does not control how independent third parties process personal data.

14. Security

We use reasonable technical and organizational measures to protect personal data, such as access controls, encrypted transmission, log monitoring, permission management, backups, server-side authentication, and security reviews.

No internet transmission or electronic storage method is completely secure. If you discover a security issue or believe your account has been accessed without authorization, please contact us promptly.

15. Children’s Privacy

NiuTools is intended for users who can lawfully use learning tools and online services. Unless authorized and supervised by a parent, guardian, school, or organization, we do not knowingly collect personal data from children.

If you believe a child provided personal data to us without appropriate authorization, contact us at privacy@niutools.com and we will respond as required by applicable law.

16. Policy Updates and Contact

We may update this Policy from time to time. Material changes may be communicated by reasonable means, such as updating this page date, in-product notice, or email. Continued use after changes take effect means you understand the updated Policy.
